DALLAS - The high court will enable a wrongful death lawsuit to proceed in opposition to town of Dallas and four law enforcement officials.

The family of a man who died in police custody in 2016 sued.

Tony Timpa referred to as police for help as he had a drug and psychological health disaster.

The town fought towards releasing physique digital camera video and whit it did come out it was apparent why. It confirmed the officers mocking the dying man.

One had his knee on Timpa’s again and neck for nearly quarter-hour and the medical expert stated that contributed to his dying.

The city of Dallas argued the officers are legally protected against lawsuits.

The Supreme Court docket upheld a federal appeals court’s ruling that may permit the case to proceed.

"The choice means that the case can proceed to trial and that there shall be no more delays from any appellate court. Also, the decision signifies that the Fifth Circuit did it right that their ruling relating to deadly force would be the regulation of the land at the very least in Mississippi, Texas and Louisiana for as long as we all know," stated Geoff Henley, an attorney for Timpa’s family.

These are the states covered by the Fifth Circuit Court docket of Appeals ruling allowing the suit to continue.

Three years ago, the Dallas district attorney dropped prison prices in opposition to three of the officers.
